In this Privacy Policy references to “Client” shall be to a person requiring the services of a Worker and whether or not in any such case a company, corporation, state, state entity, trust, joint venture, partnership, agency, association or other entity (whether or not having separate legal personality)); references to “Worker” shall be to a person who registers on the Site as a construction worker (which, without limitation, includes Architects, Surveyors, Civil Engineers, Construction Managers and Facilities Managers); references to “you” and “your” shall be both to the Client and/or a Worker.
This Privacy Policy details how we will use your personal data obtained as a result of you registering on the http://www.construction4professionals.co.uk/ web site ("the Site"). If you do not accept the terms of this Privacy Policy, please do not access, use or submit material to the Site.
The Site is operated and owned by E-Fit Recruitment Limited ("we", "us" and "our") a company incorporated under the laws of England under Company No 6372061.
Links to other websites are available on the Site. We have no control over such other websites including over the approach to privacy of personal data adopted by the parties who provide such websites.
Privacy Policy
We are committed to protecting your privacy and we comply with the Data Protection laws applicable to the UK. Details of how we collect, use and disseminate your personal data is described below. We reserve the right to modify our policy at any time, such modifications becoming effective immediately upon posting the updated Privacy Policy on the Site.
The data we collect about you
- We obtain personal data about you that you provide to us when you register on the Site or submit to us as part of your use of the Site. This personal information includes data such as your telephone number, name, address, e-mail address, fax number, personal service company details, unique personal identifiers, financial information such as bank account or building society details together with current, and past work details and requirements, as well as future ones.
- We also obtain information about you if as part of the services provided by us on the Site we take up references from past employers/clients.
- Information is only retained and used in a lawful, fair and relevant way in order to match Clients with Workers through use of the Site.
- We may also record and store any telephone calls you have with our staff for record keeping and quality control purposes.
- We may undertake references, and other lawful checks, on a Worker where a Client requests that we do so. By registering on the Site a Worker consents to us doing so. Each Worker and Client confirms that any third party information provided to us by the Worker or Client (including, without limitation, personal data of individuals connected with a Client) will be provided with the consent of any relevant third party including, without limitation, any referee.
- In order to ensure that the data we hold is accurate and current, we ask you to update your registration details and CV as often as is necessary and recommend at least every 3 months. Our service to you is reliant on you supplying us with accurate and complete information about you and your requirements via your registration details, CV, certificates, references, skills analysis and talking to our consultants. It is incumbent that you check your details for accuracy and inform us as soon as possible of any inaccuracies so that we may correct them.
- Your Internet Protocol address may be stored to assist in the diagnosis of problems with our server and/or used in order to identify your requirements. We may use cookies (persistent, or session client side information) to store non-personal information.
How we process your data.
- Your personal data will be stored in our database in our UK based data processing centre hosted by our selected service provider.
- If a Worker consents to being contacted by us or any of our associated companies all data stored on our database is available to our or their personnel to run searches to find matches between requirements and individuals stored on the database. Such searches will use key data such as discipline, availability, qualifications, location, industry knowledge, skills, experience and salary / remuneration requirements. The Site allows such personnel to prioritise individuals according to the quality of the match with the client's requirements. The appropriate candidates are then selected for presentation to the recruiting organisation via a resume. The selection process also takes into account any extra knowledge we have about you or the client's preferences.
- Information may be disclosed to a party who proposes to acquire all or a substantial portion of our business or shares.
Amendment and Retention of Data
We will remove any personal data regarding a Worker 24 months after such Worker registered on the Site. We will retain all personal data provided to us by a Client during the period for which such Client is registered on the Site and will remove such data within 12 months of such Client ceasing to be so registered. A Worker and a Client can suspend use of their details on the Site at any time using the method specified on the Site. If a Worker or a Client does this, all copies of such Worker’s or Client’s details will be removed from our database save for an archival copy retained indefinitely for audit and records purposes which is not accessible by you or third parties on the Internet. Clients who have subscribed to the Site and have therefore obtained access to our database may have retained copies of a Worker’s data (including, without limitation, their CV) in their own records. We are not responsible for how such Clients retain or use such data.
Third party Use
As the Site can be accessed worldwide, some of the Clients and Workers that obtain personal data from the Site may be located in countries outside of the European Economic Area. The data protection rules applicable in such countries may not be equivalent to those in the European Economic Area which protect the use of your personal data. By continuing to access, use or submit materials to the Site, you expressly consent to transfers of your personal data to such countries occurring.
Your Legal Data Protection Rights
You have the right to request a copy of the information held by us about you in our records in return for the payment of a small fee. You also have the right to correct any inaccuracies in the information and various other data subject rights under the UK Data Protection laws.
Security Policy
Our staff and the Site administration staff contracted to us are the ONLY parties to have access to your personal details save as set out above. The Site is merely a location for Clients to place details of job vacancies and for Workers to place their details. We are not involved in any transaction between the Client and any Worker. All dealings between the Client and any Worker are a matter between the Client and the relevant Worker and we shall not have any liability whatsoever in relation thereto.
Associated Companies
In this Privacy Policy “associated companies” means any company which is a parent undertaking or subsidiary undertaking or a subsidiary undertaking of its parent undertaking within the meaning of sections 258 and 259 of the Companies Act 1985.
